Could Denver Be The Next City to Pass a Construction Defect Ordinance?

A recent announcement from the City and County of Denver suggests that Denver may be following suit with other cities by introducing a new ordinance to address construction defect reform.

The proposed ordinance would place restrictions on the rights of condominium associations and HOAs to bring actions against developers and builders alleging construction defects. Although the proposed ordinance includes aspects similar to construct defect ordinances recently approved in other cities, it will also likely include additional – yet potentially significant – elements that could make it even more difficult to hold developers accountable.

The proposed ordinance is scheduled for review by the Denver City Council on October 27, 2015.
